Worker’s Compensation claims, when disputed, shift the cost of medical care to group health plans. Disputes between the applicant employee and respondent employer take place without the participation of the group health plan. In short, the group health plan does not possess a seat at the table. This presentation uses an actual case to shed light on this process. After some introductory background, this session discusses the interaction between worker’s compensation and group health through a case study. The case study draws on Attorney Beckley’s amazing work in Blue Cross & Blue Shield of Fla. v. Zenith Ins. Co. We expect a lively interaction since it’s a story known to all subrogation specialists.
